Without the bracket there is a significant burn risk, so the item is no longer useable. Amazon says there is only a one month return window. So, buyer beware. In concept, the teapot seems to be great - packs small, heats fast, etc. But this is a design flaw, not a manufacturing defect, so every unit has this risk of failure. Edit: I tried contacting Amazon about this issue and they put me in touch with the seller. After looking at a picture of the break, the seller CHEERFULLY and PROMPTLY replaced the product. Very impressive, and not the story you hear much in Amazon reviews. There are other similar products out there. I like this one because it heats fast, has a decent auto shutoff, and has a slimmer profile when stored.
